§ 1 Scope of application

(1) These General Terms and Conditions (hereinafter referred to as GTC) apply only to the contractual relationship between Grundl Leadership Institut GmbH, Richard Kohler Weg 8 in 78647 Trossingen, represented by Boris Grundl, and entrepreneurs and consumers (hereinafter referred to as customers or participants and also clients). Entrepreneurs within the meaning of Section 14 of the German Civil Code are clients who, when concluding the legal transaction, are acting in the exercise of their commercial or independent professional activity.

(2) The version of the General Terms and Conditions valid at the time of conclusion of the contract shall be decisive.

(3) In addition, the agreement made with GLI shall be deemed a subsidiary agreement. We do not accept any deviating terms and conditions of the client. This shall also apply if we do not expressly object to their inclusion.

 

§ 2 Subject matter of the contract and conclusion of the contract

We offer services tailored to the individual needs of each client. The following transformation packages comprise the following components:

  • The contract is concluded upon acceptance of the individually offered transformation package between GLI and the client.

 

§ 3 Right of withdrawal

(1) If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with the statutory provisions.

The withdrawal period is fourteen days from the date of conclusion of the contract. To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

(2) The right of withdrawal does not apply to distance contracts.

(a) for the delivery of goods that have been manufactured according to customer specifications or that are clearly tailored to personal needs or that are not suitable for return due to their nature or that can spoil quickly or whose expiration date would be exceeded,

(b) for the delivery of audio or video recordings or software, provided that you have unsealed the delivered data carriers.

(3) The customer expressly agrees that the Grundl Leadership Institute may begin performing the contract before the expiry of the withdrawal period specified in § 1 (1). The customer acknowledges that by giving this consent, they lose the right to withdraw from the contract as soon as Grundl Leadership Institute has begun to perform the contract. If the user nevertheless withdraws from a contract for paid services, the customer is obliged to reimburse Grundl Leadership Institute for the value of the services provided until the withdrawal takes effect.

§ 4 Prices and terms of payment

(1) All prices quoted for the transformation packages offered are net prices plus statutory sales tax and can be found in the respective individually tailored offer.

(2) By concluding the contract, the customer undertakes to pay upon invoicing in accordance with the agreed payment method (in monthly installments or as a one-time payment).

(a) By concluding the contract in accordance with §2 (1) and/or (2), the customer undertakes to pay the invoice in accordance with the agreed payment method (in monthly installments or as a one-off payment).

(b) By concluding the contract in accordance with §2 (3), the customer undertakes to pay within 10 days of invoicing or placing the order, without deduction.

(3) Failure to attend training sessions or appointments (e.g., due to illness or non-use of the online learning environment) does not release the contractual partner from payment. The appointment will be forfeited without replacement if it is not canceled or rescheduled at least 48 hours in advance. The implementation discussions must be held within the communicated period. Appointments that are not canceled in a timely manner will be charged a no-show fee of €150 plus VAT.

(4) Travel expenses incurred for keynote speeches will be invoiced 1:1 after the respective seminar date. Invoices will be issued by GLI. Payment is deemed to have been received upon receipt in the specified bank account.

(5) The client shall cover travel costs and expenses for arrival and departure for keynote speeches, as well as accommodation for the speaker and co-speaker (as required). Travel costs are calculated as follows: journeys under 300 km by first-class train, beyond that by economy class airplane plus any taxi costs incurred. For travel by car, €0.89/km plus VAT will be charged. For overnight stays, rooms in a hotel with upscale amenities must be booked. The client will clarify the assumption of costs with the hotel. The following rule applies to appointments with Boris Grundl: The client covers the travel costs and expenses for arrival and departure, as well as overnight stays for the speaker and one accompanying person (if necessary). Travel costs are calculated as follows: Journeys under 300 km by first-class train, beyond that by business-class plane plus any taxi costs incurred. For travel by car, €0.89/km plus VAT will be charged. For overnight stays, a wheelchair-accessible room in a four-star (or higher) hotel must be booked. The client will clarify the costs with the hotel.

Section 5 Termination

(1) This agreement applies to all agreed training sessions. Individual appointments cannot be canceled.

(2) If the client cancels up to 90 working days before the first date: no costs except for the first installment or 10% of the invoice amount for a one-time payment.

(3) If the client cancels up to 60 working days before the first appointment: 50% of the agreed fee as a cancellation fee.

(4) If the client cancels 59 working days or less before the first appointment: 100% of the agreed fee as a cancellation fee.

(5) The claim to the respective fee arises on the day on which GLI receives the client's notice of termination and is also due at this point in time. Ordinary termination is only valid if it is made by registered letter.

 

§ 6 Securing performance

If a seminar date cannot be held as a face-to-face event due to force majeure, illness, accident, or other circumstances beyond GLI's control (e.g., lockdown), GLI is entitled, without any liability for damages, to provide the services in the form of an online seminar or to reschedule the seminar for a new date.

If a coaching appointment cannot be kept due to force majeure, illness, accident, or other circumstances beyond GLI's control, GLI is entitled to reschedule the services for a new date, excluding any liability for damages.

 

§ 7 Obligations of the client to cooperate

(1) The client is obliged to cooperate appropriately within reasonable limits. The obligations to cooperate include, in particular, informing GLI of all circumstances that are relevant to the execution of the order, both before and during the term of the order.

(2) The following obligations to cooperate apply to in-house events and keynote speeches:

(a) It is solely the responsibility client to advertise and recruit participants for events.

(b) The client shall organize the venue and catering for participants and speakers and bear the costs thereof.

(c) If necessary, the client shall be responsible for producing the seminar documents, provided that GLI delivers a copy template in good time.

(d) If necessary, the client shall arrange for the provision of the necessary technology (screen, projector, sound system with speakers for voice and laptop, headset microphone, height-adjustable flipchart, etc.).

 

§ 8 Copyrights, reproduction, recordings, data protection

(1) GLI is the sole owner of the copyright to the event documents. Any further use, in particular publication and sale, requires the express prior written consent of GLI.

(2) Upon registration, the client shall inform participants that video or audio recordings or recordings of the lecture or training sessions, as well as reproduction and distribution, are not permitted. In the event of non-compliance, GLI reserves the right to take legal action against the client and/or individual participants.

(3) If the event takes place as an online seminar or hybrid event, it may be recorded by agreement. The client must give their written consent to the recording of the event and inform the participants in advance.

(4) If the event is recorded, the recording can be made available to the client via the Online Learning World for a one-time license fee of €990.00 plus VAT.

(5) Personal data that is necessary to establish or amend a contractual relationship with the client, including its content, as well as personal data for the provision and performance of our services, will of course only be processed by us in accordance with the applicable legal provisions of the GDPR. § 9 Liability

(1) GLI shall only be liable to the client in cases of intent and gross negligence.

(2) In the event of gross negligence, GLI shall not be liable for indirect and/or consequential damages, in particular for lost profits, futile expenses, business interruptions, or loss of production.

 

§ 10 Severability clause, place of jurisdiction, final provisions

(1) Tacit or written side agreements shall be made exclusively with GLI and require the written approval of GLI. Amendments and additions to this contract or the side agreement must be made in writing. This also applies to any cancellation or waiver of this written form clause.

(2) Should any provision of this contract be invalid or unenforceable or become invalid or unenforceable in the future, the remaining provisions of this contract shall remain unaffected. The parties hereby undertake to agree on a valid provision to replace the invalid or unenforceable provision, which comes as close as possible to the legal and economic meaning and purpose of the invalid or unenforceable provision. The same applies to the filling of gaps in this contract.

(3) The parties agree that Spaichingen shall be the exclusive place of jurisdiction for any disputes, to the extent permitted by law.

(4) This contract is governed by the laws of the Federal Republic of Germany.

(5) As an online company, we are obliged to inform you, the consumer, about the European Commission's online dispute resolution platform (ODR platform). This ODR platform can be accessed via the following link: https://webgate.ec.europa.eu/odr. However, we do not participate in dispute resolution proceedings before a consumer arbitration board.

§ 1 Scope of application

(1) These General Terms and Conditions of Use apply to all contracts and order processes concluded via our online platform or by email between us, Grundl Leadership Institut GmbH, Richard Kohler Weg 8, 78647 Trossingen, Germany ("Grundl Leadership Institut") and you as our customer. These Terms and Conditions of Use apply regardless of whether you are a consumer, entrepreneur, or merchant.

(2) All agreements made between you and us in connection with the contract are set out in these Terms of Use and our written order confirmation/declaration of acceptance.

(3) The version of the Terms of Use valid at the time of conclusion of the contract shall be decisive.

(4) We do not accept any deviating terms and conditions of the customer. This also applies if we do not expressly object to their inclusion.

 

§ 2 Conclusion of contract / User account / Contract execution

(1) By completing the online registration process and creating a user account, a user agreement with the Grundl Leadership Institute is established. This agreement offers the user the opportunity to receive free services on the Grundl Leadership Institute platform. The presentation of free and paid services does not constitute a binding offer by the Grundl Leadership Institute. Rather, the user is given the opportunity to submit a binding offer to conclude a user agreement.

(2) The Grundl Leadership Institute has the right to downgrade, restrict, or otherwise modify free services at any time and without prior notice. This also applies explicitly to paid services provided by the Grundl Leadership Institute to the user free of charge for trial purposes (trial use). Provision for trial purposes is generally for a period of two weeks, unless otherwise agreed with the user. The Grundl Leadership Institute has the right to reduce, restrict, or otherwise modify the services provided for trial use at any time without prior notice. Subject to the provisions of § 14, the Grundl Leadership Institute does not assume any warranty, compensation, maintenance, or support obligations (as defined below in § 7) or availability obligations for free services. Free services do not constitute a guarantee for (future) product features of paid services.

(3) The services accessible to the user as part of their subscription and the content to be delivered are specified in the user agreement. Statements and explanations by the Grundl Leadership Institute regarding the services in advertising materials, on websites, and in documentation are intended solely as a description of the nature of the services and do not constitute a guarantee or assurance of any characteristics.

(4) If the user wishes to make use of paid services on the Grundl Leadership Institute platform, the user submits a binding offer. This is done by completing the order process and submitting the order by clicking on the "Place order" button. By submitting an order via our platform by clicking on the "Place order" button, you are placing a legally binding order. You are bound to the order for a period of two (2) weeks after placing the order; your right to cancel your order in accordance with § 3 remains unaffected. The user will receive an order confirmation from the Grundl Leadership Institute by email to the email address provided by them. This order confirmation constitutes acceptance of the offer by the Grundl Leadership Institute. This creates a binding contract between the user and the Grundl Leadership Institute. In this case, the user agreement consists of the order confirmation corresponding to the customer's order and these General Terms and Conditions of Use.

(5) The Grundl Leadership Institute will not store the contract text, in particular the terms of use valid at the time of conclusion of the contract and the order confirmation issued. The concluded contract can therefore no longer be made available to the user by the Grundl Leadership Institute.

(6) The Grundl Leadership Institute is entitled to engage subcontractors, including external software suppliers, to fulfill its contractual obligations in accordance with the order.

§ 4 Rights of use/property rights

(1) In accordance with the terms of the user agreement and the following provisions, the user shall receive, subject to payment of the remuneration owed and due or within the scope of a free service, the simple, non-exclusive, non-transferable right to use the subscribed services or to use the free services for themselves and for the contractually specified authorized users for their own purposes. The services are offered as currently described on the Grundl Leadership Institute website, including the user onboarding process (if available), and on the website.

(2) The user may not reproduce, process, share, or publicly reproduce the content of the services without the written consent of the Grundl Leadership Institute, unless this is expressly permitted by functions integrated into the services.

(3) The Grundl Leadership Institute is entitled to take technical measures to prevent use beyond the permitted scope, in particular to install appropriate access blocks. In the event of misuse, the Grundl Leadership Institute is entitled to immediately block access to the services. Further rights and claims of the Grundl Leadership Institute, in particular the right to extraordinary termination for good cause and claims for damages, remain unaffected.

(4) Under no circumstances is the user entitled to receive the source code of the services.

(5) The Grundl Leadership Institute and any contractors are and remain the owners of all property rights, including copyrights, database rights, patents, trade secrets, trademarks, and all other intellectual property rights and technical solutions to and in connection with the services, in particular the teaching content and didactic methods. The user acknowledges that the rights granted after placing an order do not give the user any property rights to the services.

(6) All rights to user data and all content, as well as to data based on or derived from user data or content, remain with the user. The user grants the Grundl Leadership Institute a simple, non-transferable, sublicensable, spatially and content-unrestricted (usage) right to use the user data and content exclusively in connection with the provision of services. The Grundl Leadership Institute is not liable for user data or content.

 

§ 5 User obligations

(1) The user is responsible for ensuring that the technical requirements for accessing the website and the services provided are created and maintained in their area, in particular with regard to the hardware and operating system software used, the connection to the Internet, and the current browser software. The Grundl Leadership Institute indicates on the website which browsers are currently supported and what other technical equipment is required.

(2) The user is obliged to take the necessary precautions to secure their systems, in particular to use the standard security settings of the browser and to use up-to-date protection mechanisms to defend against malware.

(3) The user is obliged to keep the access data and passwords secret and to prevent unauthorized use by third parties; he shall also ensure that the users who are jointly authorized by contract Obligation comply with this Obligation .

(4) The user is solely responsible for the content of all data and any other material displayed, published, uploaded, stored, exchanged, or transmitted by the user via or with the help of the services (collectively, "content"). The Grundl Leadership Institute is not in a position to control the information transmitted by the user during the use of the services or to guarantee the accuracy of this information. The Grundl Leadership Institute may, without prior notice and without liability, investigate complaints or alleged violations of the order and may take measures that the Grundl Leadership Institute deems appropriate. This includes rejecting content, removing content, and restricting, blocking, or terminating the user's access to the Services.

(5) The user shall ensure that the information in their user account is up to date and correct. In the event of unauthorized use of a password or account, or any other known or suspected security breach or misuse of the services, the user is obliged to inform the Grundl Leadership Institute immediately.

 

§ 6 Implementation calls

(1) If agreed in an order, the Grundl Leadership Institute shall provide the user with fee-based services in accordance with the provisions of this § 6, which enable the user to participate in teaching units with trainers in an online livestream ("implementation calls"). Implementation calls are services within the meaning of § 611 BGB (German Civil Code).

(2) In order to participate in an implementation call, the user must access the online platform, the web address of which will be provided to the user by the Grundl Leadership Institute ("online platform"). Each published date is subject to the availability of the Grundl Leadership Institute's trainers and the availability of a free place in the desired unit.

(3) Implementation calls are made available via a web browser. It is the responsibility to meet additional technical equipment requirements, which can be viewed in their current version on the Grundl Leadership Institute website.

(4) In order for the user to be able to use the implementation calls, it may be necessary for the user to use third-party video conferencing software, as specified in the current version of the technical equipment requirements. The user is solely responsible for procuring such video conferencing software, including all rights of use, at their own expense, and the Grundl Leadership Institute makes no representations or warranties regarding the availability and/or specific functions of third-party video conferencing software.

(5) The Grundl Leadership Institute strives to ensure the availability of the published dates. However, the Grundl Leadership Institute reserves the right, without giving reasons, to cancel the appointment up to twenty-four (24) hours before the start of an implementation call and to set a replacement date. In this case, the Grundl Leadership Institute shall be released from its obligation to perform for the canceled appointment.

 

§  7 Maintenance and Support for Paid Services

(1) The Grundl Leadership Institute offers maintenance and support services for paid services to the extent specified in the order. "Support" refers to the Grundl Leadership Obligation to respond to user support requests for paid services by assisting in identifying errors and providing support. "Maintenance" refers to the Obligation Grundl Leadership Institute to remedy malfunctions and so-called bugs for paid services.

(2) Support is available to the user by email at support@grundl-institut.de or via another email address provided by the Grundl Leadership Institute for this purpose and/or via live chat on the Grundl Leadership Institute website and/or at the telephone number provided on the Grundl Leadership Institute website, in all cases from Monday to Friday during regular business hours.

(3) The Grundl Leadership Institute shall make reasonable efforts in accordance with applicable industry standards to maintain fee-based services in such a way as to minimize disruptions and interruptions to the services. The user can report disruptions to the Grundl Leadership Institute by email at support@grundl-institut.de or any other email address provided by the Grundl Leadership Institute for this purpose and/or via live chat on the Grundl Leadership Institute website. The Grundl Leadership Institute will make commercially reasonable efforts to correct all reported errors in a timely manner, provided that (a) the user provides the Grundl Leadership Institute with a detailed description of the error and its reproducibility, and (b) this is done depending on the priority of the error, which is determined by the Grundl Leadership Institute at its sole discretion.

 

§ 8 Availability of paid services / Right to make changes

(1) The Grundl Leadership Institute aims to achieve an average service availability of 98% per calendar year. The decisive factor is the availability of services at the transfer point of the online platform system to the Internet, with the exception of

(a) temporary unavailability due to scheduled or unscheduled maintenance work by the Grundl Leadership Institute or third-party providers, and

(b) Unavailability for reasons beyond the control of the Grundl Leadership Institute.

The Grundl Leadership Institute will make reasonable efforts to announce scheduled interruptions to services in advance.

(2) The user acknowledges that access to paid services, such as the user's Internet access, is the responsibility of the user and that the Grundl Leadership Institute is not liable for failures of the Internet connection or the user's technical devices and equipment.

(3) The Grundl Leadership Institute endeavors to continuously adapt the platform and services to current requirements. It therefore reserves the right to make changes to adapt the system to the state of the art, changes to optimize the system, in particular to improve user-friendliness, as well as changes to content, insofar as the latter are necessary to correct errors, to update and complete, to optimize the program technology, or for licensing reasons. Grundl Leadership Institute thus reserves the right to make new versions and updates to the services, in particular changes to the design, operational procedures, technical specifications, systems, and other functions of the services. If such a change leads to a significant reduction in the services to which the user is entitled, the user may either demand a reduction in remuneration in line with the reduction in value or terminate the user agreement without notice. The right of termination may be exercised within a period of eight weeks from the date of the change.

 

§ 9 Fees / Terms of payment / Set-off restriction

(1) The fee payable by the user for the provision of services under a subscription is specified in the user agreement. The fee for subscriptions is payable monthly in advance for the subscription period and subsequent renewal periods.

(2) Invoices are generally sent electronically by the Grundl Leadership Institute. Payment must be made by the user within 10 days of the invoice date.

Unless expressly stated as gross prices, all prices are subject to the statutory sales tax applicable at the relevant time.

(3) If payment of the fees is not made on time, the Grundl Leadership Institute is entitled to block the user's access to the services.

(4) Offsetting against the user's own claims is excluded, unless the claims have been legally established or recognized by the Grundl Leadership Institute.

 

§ 10 Term/Termination

(1) The term of an order begins at the time specified therein. Free services are provided for an indefinite period.

(2) Free services may be terminated at any time by either party without notice.

(3) Paid services are concluded for the fixed term agreed in the order.

(a) Paid services cannot generally be terminated early.

(b The usage agreement may be terminated by either party with two weeks' notice to the end of the respective subscription or renewal period. Unless terminated, the agreement shall be automatically renewed for one month at a time.

(c) Any extraordinary right of termination for good cause shall remain unaffected by this. Good cause shall be deemed to exist in particular if the user is more than 45 days in arrears with their payment obligations or if one of the parties materially breaches its performance obligations and the breach is not remedied despite the setting of a reasonable deadline.

(4) The Grundl Leadership Institute reserves the right to change the fees with effect for the subsequent extended term. Any change in fees must be notified in writing (email is sufficient) at least sixty (60) days before the end of the current term.

 

§ 11 Lifetime License

(1) A "lifetime license" is a license to use paid services that is granted by Grundl Leadership Institute for life, notwithstanding the provisions of § 10 (3) and (4). It shall only terminate in accordance with this § 11.

(a) upon the death of the user, or

(b) if Grundl Leadership Institute ceases to provide the services altogether, or

(c) if Grundl Leadership Institute ceases its business operations altogether.

(2) A lifetime license is granted to the user personally, and the associated rights and obligations are not transferable to the user's heirs. Grundl Leadership Institute may request proof of identity from the user at any time.

(3) Ordering a lifetime license entitles the user to use the services as long as the respective services ordered are offered and supported by Grundl Leadership Institute as part of the services ("term of the lifetime license").

(4) A lifetime license applies only to the services described in the respective order and does not extend to any future services.

(5) The provisions of § 8 (3) apply to updates and changes to services within the scope of a lifetime license. However, Grundl Leadership Institute may only change the services within the scope of a lifetime license to the extent that this is reasonable, taking into account the legitimate interests of the user and Grundl Leadership Institute.

(6) Termination of an order for a lifetime license for good cause is excluded for both contracting parties. The right to terminate an order for a lifetime license for good cause in accordance with § 10 (3) (c) remains unaffected by this.

 

§ 12 Warranty

The Grundl Leadership Institute guarantees that the paid services have the essential functions described in the current documentation for the respective version of the paid services. In the event of a breach of this warranty, the Grundl Leadership Institute is obligated to make commercially reasonable efforts to adapt the paid services so that they essentially correspond to the documentation. If the Grundl Leadership Institute is unable to substantially restore this function within thirty (30) days after written notification of the breach, the user is entitled to cancel the order by written notice and receive a pro-rata refund of any fees paid in advance by the user for unused access to paid services. The user may only exercise the aforementioned rights if the user notifies the Grundl Leadership Institute of such violations in writing and has installed and configured the paid services in accordance with the documentation. Strict liability on the part of the Grundl Leadership Institute for the existence of initial defects in accordance with § 536a BGB (German Civil Code) is excluded. Claims for damages by the user based on a breach of this warranty are subject to the restrictions set out in § 14.

 

§ 13 Data protection

§ 14 Right to exemption

The user shall indemnify the operator and its employees or agents against all third-party claims arising from alleged or actual infringements of rights and/or infringements of third-party rights resulting from actions of the user in connection with the use of the platform for which the user is responsible. In addition, the user undertakes to reimburse the operator for all costs incurred by the operator as a result of claims by third parties. Reimbursable costs also include the costs of reasonable legal defense.

 

§ 15 Limitation of liability

(1) The Grundl Leadership Institute shall be liable to the user in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of futile expenses.

(2) In other cases, the Grundl Leadership Institute shall only be liable—unless otherwise specified in paragraph 3—for breaches of contractual obligations whose fulfillment is essential for the proper execution of the contract and on whose fulfillment the user may regularly rely (so-called cardinal obligations), limited to compensation for foreseeable and typical damage. In all other cases, the liability of the Grundl Leadership Institute is excluded, subject to the provision in paragraph 3.

(3) The Grundl Leadership Institute's liability for damages resulting from injury to life, limb, or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

 

§ 16 Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user has placed the order as a consumer and has their habitual residence in another country at the time of ordering, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.

(2) If the user is a merchant and has their registered office in Germany at the time of placing the order, the exclusive place of jurisdiction shall be the registered office of Grundl Leadership Institut, Richard Kohler Weg 8, 78647 Trossingen, Germany. In all other respects, the applicable statutory provisions shall apply to local and international jurisdiction.

III. General Terms and Conditions for Seminars

All prices include statutory VAT. Once we have received your registration, you will receive your registration confirmation and invoice, which is due immediately. You will receive all information about the venue, travel arrangements, or the format of the event (e.g., online intensive seminar) in good time before the start of the event. If you wish to change your registration, an administration fee of €178.50 including VAT will be charged. If you cancel after the withdrawal period has expired, the entire seminar fee will be charged/retained as a cancellation fee. If you cancel your participation 14 days or less before the start of the seminar, additional cancellation costs incurred by the hotel may be charged in addition to the administrative fee for cancellation/rebooking. If the event cannot be held as a face-to-face event due to force majeure, illness, accident, or other circumstances beyond the Institute's control (e.g., lockdown), the Institute is entitled, to the exclusion of any liability for damages, to provide the services in the form of an intensive online seminar or to reschedule the event for a new date. In the event of a speaker's absence, the Institute reserves the right to appoint a replacement speaker. By accepting and confirming these terms and conditions, you agree to binding participation, regardless of the form in which the event is held.

The seminar fee includes: Live seminar with Boris Grundl in person, seminar materials, on-site catering (conference drinks, lunch on the second and third days of the seminar, group dinner on the second day of the seminar). The seminar feedoes not include: Accommodation/breakfast.

Fair play guarantee

We know how valuable the content of our seminars is. If, contrary to our experience, you are not satisfied with this seminar, please return your workbook and name tag to us by 12 noon on the second day of the seminar. You will then receive a full refund of the seminar price (minus an administration fee of €178.50 including VAT per person) within 14 days.

In the event of cancellation, additional costs incurred by the hotel may be charged in addition to the administrative fee.

  1. Cancellation policy

right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us (Grundl Leadership Institut GmbH, Richard Kohler Weg 8, 78647 Trossingen, Germany, phone: +49 7425 – 20 997-0, email: info@grundl-institut.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation:

If you withdraw from this contract, we shall reimburse you for all payments we have received from you without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this repayment. Expiration of the right of withdrawal: The right of withdrawal expires prematurely if the platform operator has begun to perform the service (e.g., individual retrieval/download) with the express consent or at the express request of the customer before the end of the withdrawal period, or if the customer has initiated this themselves.

  1. Notice regarding expiry of the right of withdrawal

According to Section 356 (4) of the German Civil Code (BGB), the right of withdrawal expires in the case of a contract for the provision of services even if the entrepreneur has completely provided the service and only began performing the service after the consumer gave their express consent and at the same time confirmed their knowledge that they would lose their right of withdrawal upon complete fulfillment of the contract by the entrepreneur. In order to ensure that, in the event that a customer makes use of this right, the services already provided up to that point are at least remunerated accordingly, a separate form is required in which the customer must expressly confirm the following by signing or, in the case of an online booking, by ticking a checkbox:
